OpenAI's Contract With AWS States OpenAI Will Retain Control Over Which Models Are Made Available to Government Agencies

AWS CEO Matt Garman announced up to $50 billion investment in US government AI infrastructure starting 2026 adding 1.3 gigawatts across AWS Top Secret AWS Secret and AWS GovCloud regions. OpenAI expanded government footprint through AWS deal March 2026 making models available through Amazon Bedrock in AWS GovCloud and classified regions for Secret and Top Secret workloads. OpenAI spokesperson stated OpenAI retains control over its technology by deciding which models are made available and AWS must provide notice before enabling especially sensitive government agencies. June 5 2026 Presidential Memorandum requires agency heads to be personally accountable for AI systems that are steerable controllable and preserve the Constitutional chain of command. Anthropic model disable event demonstrated Constitutional chain of command for AI systems runs through model provider to administration not from agency head to AI system. No FedRAMP requirement no GSA contract clause and no OMB memorandum specifies the constitutional command architecture making agency head Constitutional steerability certification demonstrable independently of cloud provider and model provider governance decisions.
