How France and Germany Blocked EU AI Enforcement - and Left 19 Nations Exposed.

The EU AI Act mandates kill-switch mechanisms for high-risk AI systems with a legal compliance deadline of August 2, 2026. The EU Commission missed its February 2026 guidance deadline. Only 8 of 27 member states have formally designated national contact points. France and Germany drove a postponement of high-risk AI obligations in November 2025, leaving 19 smaller member states - including Estonia, Latvia, Lithuania, Slovenia, Croatia, Portugal, and Greece - facing legal compliance obligations with no operational doctrine to meet them. This paper documents the three-layer constitutional enforcement gap and presents the Fijishi Sovereign Algorithmic Immunity Doctrine, Meta-Compliance Architecture, and Institutional Failover Charter as the kill-switch compliance architecture available to any EU member state independent of Franco-German political dynamics and CEN-CENELEC harmonised standards delays.
