Switzerland signed the Council of Europe Framework Convention on Artificial Intelligence on March 27 2025 but has not ratified it and it is not part of Swiss law. A consultation draft for implementing legislation is expected by end of 2026. The Federal Data Protection and Information Commissioner is Switzerland's primary AI enforcement body by default through application of the Federal Act on Data Protection to AI-supported processing. The FDPIC is characterised as generally reluctant to take a decisive stance and rarely providing guidance for private actors. Switzerland hosts more international organisations than any other nation including UN agencies WHO WTO ICRC and hundreds of others all deploying AI systems under governance structures transcending Swiss national constitutional authority. The Swiss-US Data Privacy Framework took effect September 15 2024. No Swiss governance document specifies the constitutional command architecture governing AI systems operated by international organisations on Swiss soil or specifying how the FDPIC invokes enforcement authority over AI systems whose governance structure answers to no single national constitutional authority. This paper documents the structural gap between Switzerland's position as host of global governance institutions and the constitutional command framework required to make AI sovereignty technically enforceable within that context.
