At GTC 2026 Nvidia published analysis stating that AI sovereignty requires enforcing data access and usage policy at runtime for agentic systems and producing audit trails of what was accessed what action was taken what policy was in effect and why. Nvidia's sovereign AI segment generated $30 billion in fiscal 2026 revenue more than triple the prior year. Nvidia powers over 78 percent of global TOP500 supercomputers. 72 percent of S&P 500 companies disclosed at least one material AI risk in 2025. Gartner predicts that by 2028 15 percent of day-to-day work decisions will be made autonomously through agentic AI. No sovereign AI programme contract signed by any government customer specifies the constitutional command architecture Nvidia described at GTC 2026 - runtime enforcement of permissions and policy with tamper-resistant audit trails of autonomous decisions. When an autonomous government AI system running on Nvidia hardware makes a constitutionally harmful decision the sovereign government bears full legal liability while Nvidia's terms of service disclaim responsibility. This paper documents the structural gap between Nvidia's GTC 2026 sovereignty definition and the constitutional command architecture absent from every sovereign AI contract their government customers have signed.
