No provision of the FREE-AI framework specifies the cryptographic audit trail required to prove in a legal proceeding that a specific autonomous financial AI decision was made by an authorised system under known constitutional parameters. Every board in India's financial sector approved an AI risk framework on June 30, 2026 against a standard that cannot be cited as constitutional proof in a court challenge to an AI-governed banking decision. This paper documents the structural gap between the FREE-AI framework's administrative governance standard and the constitutional command layer required to make board-level accountability for autonomous AI decisions legally defensible.
