Australia's Digital ID Act 2024 established three co-regulators for the Australian Government Digital ID System - the ACCC as Digital ID Regulator the OAIC as privacy enforcer and Services Australia as system operator - who signed a Memorandum of Understanding for cooperation. The AGDIS expansion to private sector participation is scheduled for December 2026 extending AI-governed identity verification across Commonwealth agencies state and territory services and private sector entities simultaneously. The UK Home Office launched a Deepfake Detection Challenge in 2026 confirming AI-driven identity attacks are live operational threats. No single entity among the three co-regulators has the constitutional command authority to invoke sovereign override over AGDIS AI systems when they continue making identity decisions based on compromised data during an active deepfake attack. The MOU creates coordination mechanism not unified constitutional command authority. This paper documents the structural gap between Australia's three-regulator co-governance architecture and the unified constitutional command layer required to make AI-governed identity decisions defensible when the AGDIS expansion creates national-scale exposure in December 2026.
