49 African nations endorsed the Africa Declaration on Artificial Intelligence at the Global AI Summit in Kigali in April 2025. The Africa AI Fund valued at $60 billion was launched combining public private and philanthropic capital. The Africa AI Council was created co-chaired by the African Union Commission and ITU. 83 percent of African AI startup funding in Q1 2025 concentrated in four nations. The Continental AI Strategy places accountability for biased systems and human rights violations at local and national level across 54 member states with 54 different legal systems constitutional frameworks and institutional capacities. Only South Africa has attempted systematic AI system registration identifying approximately 200 deployed systems after 18 months. No AU institution has specified the constitutional command architecture governing what AI systems deployed under the $60 billion Fund are permitted to do across national boundaries or which authority has constitutional command override jurisdiction over cross-border AI decisions. Phase 2 deployment begins 2028. This paper documents the structural gap between continental AI investment scale and the constitutional command doctrine required to govern it across 54 sovereign jurisdictions.
