Governance

Independence in engagements

  • Fees are fixed at intake (or, for Juris, when a matter is instructed), before any work begins, and do not depend on the finding or, for Juris, on the outcome of the matter.
  • Fijishi does not certify a system it helped design or build.
  • Fijishi does not accept an engagement from, or a fee from, the vendor whose contract it reads.
  • Juris is instructed only by licensed counsel acting for a firm.
  • Fijishi never reviews, for a buyer, the contract for a product it has certified, and never certifies a product it has reviewed for a buyer in a Procurement Review.
  • No referral fee is paid or accepted, either way.
  • A certificate is valid for one year at most; renewal is a new engagement with its own fixed fee, decided afresh.
  • A Portfolio Screening uses public evidence only, is delivered only to its client, and never takes a fee from a company it covers.
  • A Deal Review needs the target companys written agreement, and its fee does not depend on whether the deal goes ahead.
  • A client who disagrees with a finding may appeal in writing to protocol@fijishi.com within 30 days of its issue, with any further evidence. The appeal has no fee and is answered in writing, with reasons, within 30 days; the finding then stands or is reissued.
  • Anyone may write to protocol@fijishi.com to ask whether a certificate number is current. We confirm only the number, the client, the system and the dates, and whether it is current, lapsed or withdrawn.
  • A certificate is withdrawn if it is shown altered or in part, or after the system or the requirement has changed materially.

Juris firewall

  • Juris does not accept an engagement adverse to a current Fijishi client, or one that challenges a finding Fijishi issued for that client.
  • Juris does not accept an engagement against a company named in a Fijishi Index entry on the subject of that entry.
  • Where a matter involves a Fijishi Certification finding, Juris works from the finding as issued; it does not revise it.
  • A firm reviewed at a reinsurers, capacity providers or investors request counts as a Fijishi client for this firewall.

These are standing policies, applied before any engagement is considered.

Independence of the Index

  • No one pays to appear in the Index, and no one can pay to change an entry.
  • No company, regulator or government was told of its entry before publication, and none had any input into its tier or band.
  • The Index does not rank jurisdictions or companies against each other.
  • We do not sell or pitch to any regulator or government the Index covers, and we do not send the Index to them unasked.
  • For a company named in an entry, our first contact is a notice of the entry, its question and the right of reply, and nothing commercial.
  • Each entry states any commercial relationship Fijishi has with a party named in it.
  • A client may quote its finding in full. It may not use Fijishi's name or logo as a badge or mark without written agreement.
As published in the Index: Who we are, independence and right of reply

Standards development

  • Fijishi's draft criteria are published in full and developed in public: working draft, public comment, numbered version, in use.
  • Comments and our responses are published, with each commenters agreement.
  • No one can pay to change a draft, and no draft is changed for a client. Standards in development

Corrections

We would rather be told we are wrong than assumed to be right. Corrections to the Index are public, dated and logged in Corrections and new evidence. Corrections, new evidence and right of reply: indexreport.protocol@fijishi.com
