1. The rules in Hong Kong

This edition found no AI-specific rule for insurers in Hong Kong. The government's policy statement on AI in the financial market (28 October 2024) is non-binding, and the regulators' joint circular of 5 March 2026 invites applications to a generative-AI sandbox and says that use cases in the sandbox should incorporate AI safety and risk management; it sets no expectations for firms outside the sandbox.

The Insurance Authority wrote about chatbots in its Conduct in Focus publication (May 2023): a chatbot's responses would be the responsibility of the insurer or intermediary deploying it. That article is context, not an issued instrument.

The question
Prudential Hong Kong Limited launched an AI Underwriter on 9 September 2026. Its financial consultants use it through a chatbot at the point of sale to obtain "preliminary indications on acceptance, exclusion, loading or additional information required within minutes". Prudential says final underwriting decisions remain with its underwriters after all relevant information has been received and reviewed. Writing about chatbots in its Conduct in Focus publication (May 2023), the Insurance Authority said that a chatbot's responses would be the responsibility of the insurer or insurance intermediary deploying it, and that the obligations attached to regulated activities would apply to the legal persons deploying a chatbot. The article does not address underwriting tools. Does Prudential apply that principle to the AI Underwriter's preliminary indications, treating an indication, if a consultant passes it to a customer, as its own responsibility as the deploying insurer? Or does it treat responsibility for a preliminary indication as resting with the consultant who passes it on?
